3. Eligibility

To use our services, you must:

  • Be at least 18 years of age or have the legal consent of a parent or guardian.
  • Have the legal authority to enter into a binding agreement.
  • Have proper authorization to request security assessments on systems you own or manage.
  • Not be prohibited from receiving services under applicable laws or regulations.

By using our services, you represent and warrant that you meet all eligibility requirements.

4. Authorized Use & Legal Compliance

All cyber security services provided by Cyber Digital Service LLC are strictly for legal and authorized use only. By engaging our services, you confirm that:

  • You are the legal owner or have explicit written authorization to request security testing on any system, network, or application.
  • You will not use our services to conduct unauthorized access, hacking, or any illegal activity.
  • You understand that unauthorized penetration testing or security assessments are illegal and punishable under applicable cybercrime laws.
  • Cyber Digital Service LLC will not be held liable for any misuse of our services by the client.

Any violation of this clause will result in immediate termination of services and may be reported to appropriate law enforcement agencies.

5. Client Responsibilities

As a client of Cyber Digital Service LLC, you agree to:

  • Provide accurate, complete, and truthful information at all times.
  • Grant necessary access, credentials, and permissions required to perform security assessments.
  • Notify all relevant stakeholders before any penetration testing or security audits are conducted.
  • Cooperate with our security team promptly and professionally.
  • Implement recommended security measures and patches in a timely manner.
  • Not share, distribute, or disclose our security reports to unauthorized parties.
  • Maintain confidentiality of all findings, vulnerabilities, and security recommendations.

6. Scope of Work

All cyber security engagements will have a clearly defined Scope of Work (SOW) agreed upon before services begin. This includes:

  • Systems, networks, and applications to be tested or secured.
  • Testing windows and approved timeframes.
  • Rules of engagement for penetration testing.
  • Deliverables and reporting format.
  • Communication protocols during the engagement.

Any activity outside the agreed scope requires a written amendment before proceeding.

7. Payments & Billing

  • All service prices are listed in USD (U.S. Dollars) unless otherwise stated.
  • Payment is required upfront before any work begins, unless a written agreement states otherwise.
  • Recurring managed services are billed on a monthly or annual basis as agreed.
  • We accept payments through our approved payment methods listed on our website.
  • All sales are subject to our No Return & No Refund Policy after the 15-minute cancellation window.
  • Overdue payments may result in suspension or termination of active services.

8. No Return & No Refund Policy

All purchases and service agreements with Cyber Digital Service LLC are final. By purchasing our services, you acknowledge and accept that:

  • No refunds will be issued after the 15-minute cancellation window from the time of purchase.
  • No returns are accepted for digital or cyber security services.
  • All sales are considered final once the cancellation window has passed.

9. Confidentiality & Non-Disclosure

Both parties agree to strict confidentiality regarding all information exchanged during the engagement:

  • All security findings, vulnerabilities, reports, and client data are strictly confidential.
  • Cyber Digital Service LLC will never disclose client information to third parties without written consent.
  • Security reports and assessments are for the client's internal use only and must not be shared publicly.
  • This confidentiality obligation survives the termination of any service agreement indefinitely.
  • Both parties may be required to sign a Non-Disclosure Agreement (NDA) prior to engagement.

10. Intellectual Property

  • All proprietary tools, methodologies, frameworks, and processes used by Cyber Digital Service LLC remain our exclusive intellectual property.
  • Security reports, documentation, and deliverables provided to the client are licensed for the client's internal use only upon full payment.
  • The client may not reproduce, distribute, resell, or publicly share any deliverable without written permission.
  • Cyber Digital Service LLC retains the right to use anonymized, non-identifiable findings for research, education, or improvement of our services.

11. Limitation of Liability

To the fullest extent permitted by law, Cyber Digital Service LLC shall not be liable for:

  • Any indirect, incidental, special, or consequential damages arising from our services.
  • Loss of revenue, data, business, or profits resulting from a cyber attack or breach.
  • Damages caused by vulnerabilities not identified within the agreed scope of work.
  • Failure of third-party tools, platforms, or services used during engagements.
  • Any breach, attack, or incident occurring after our engagement has concluded.
  • Client's failure to implement recommended security measures and resulting consequences.

Our total liability for any claim shall not exceed the total amount paid for the specific service in question.

12. Indemnification

You agree to indemnify, defend, and hold harmless Cyber Digital Service LLC, its owners, employees, contractors, and affiliates from any and all claims, damages, losses, or expenses (including legal fees) arising from:

  • Your misuse of our cyber security services.
  • Unauthorized security testing conducted using our tools or guidance.
  • Your violation of these Terms or any applicable law.
  • Any third-party claims resulting from your actions or omissions.

13. Third-Party Tools & Platforms

Our services may utilize industry-standard third-party security tools, platforms, and software. Cyber Digital Service LLC is not responsible for:

  • The terms, conditions, or policies of third-party tools used.
  • Downtime, errors, or failures of third-party platforms.
  • Data handling practices of third-party software vendors.

All third-party tools used are industry-recognized and comply with applicable security standards.

14. Termination of Services

Cyber Digital Service LLC reserves the right to terminate or suspend services at our discretion, including but not limited to:

  • Violation of these Terms or our Authorized Use Policy.
  • Non-payment or chargebacks.
  • Abusive, threatening, or fraudulent behavior toward our team.
  • Use of our services for illegal or unauthorized purposes.
  • Any activity that puts our team, systems, or reputation at risk.

Upon termination, all outstanding balances remain due and payable immediately.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America. Any disputes arising from these Terms or our services shall be resolved through binding arbitration or in the appropriate courts of jurisdiction, and you consent to personal jurisdiction in such courts.

16. Changes to These Terms
